Agreement to Terms
By accessing or using the Advertile website (advertile.com) or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our website or services.
These Terms and Conditions apply to all visitors, clients, and users of Advertile's website and services.
Services
Advertile provides AI-powered UGC video ad creative services for eCommerce brands. Our services include creative strategy, scriptwriting, AI video production, editing, and delivery of finished video ad creatives for use on platforms including Meta (Facebook and Instagram) and TikTok.
The specific scope of services, pricing, and deliverables for each client engagement are agreed upon prior to commencement and outlined in our service confirmation communications.
Service Plans and Pricing
Monthly Plans: Our services are available on a month-to-month basis. There are no long-term contracts. You may cancel at any time before the next billing cycle begins.
Payment Terms: Invoices are issued at the start of each billing period and are due within 7 days of receipt. Payment is accepted via international bank transfer in USD.
Late Payments: If payment is not received within 14 days of the invoice date, we reserve the right to pause delivery of services until the outstanding balance is settled.
Refunds: Due to the custom nature of our services, we do not offer refunds once production has commenced. If you are dissatisfied with your deliverables, we offer revision rounds as specified in your plan. We will work with you to resolve any quality concerns.
Revision Policy
Each service plan includes a specified number of revision rounds. Revisions must be requested within 7 days of delivery. Revision requests must be specific and relate to the original brief. Requests for entirely new concepts or significant changes to the approved script do not constitute revisions and may be subject to additional charges.
Intellectual Property
Your content: Any product images, brand assets, or materials you provide to Advertile remain your property. You grant us a limited licence to use these materials solely for the purpose of producing your ad creatives.
Our deliverables: Upon receipt of full payment, you receive full ownership and usage rights to all video ad creatives we produce for you. You may use these creatives on any paid advertising platform without restriction.
Our methods and tools: Our creative frameworks, scripting methodologies, production processes, and proprietary approaches remain the exclusive intellectual property of Advertile. You may not reproduce or resell our methods or use them to offer competing services.
Client Responsibilities
To enable us to deliver our services effectively, you agree to:
- Provide accurate and complete information in your brief
- Review and approve scripts within 3 business days of submission
- Provide feedback and revision requests within 7 days of delivery
- Ensure you have the rights to any product claims made in your brief
- Comply with the advertising policies of the platforms where you intend to run the creatives
Prohibited Uses
You may not use our services or website to:
- Promote products or services that are illegal in your target market
- Make false or misleading claims about your product
- Advertise products that violate the terms of service of any advertising platform
- Infringe upon the intellectual property rights of any third party
- Engage in any activity that is harmful, fraudulent, or deceptive
We reserve the right to refuse or terminate service to any client whose use of our creatives violates these restrictions.
Disclaimer of Warranties
Our services are provided on an "as is" basis. While we strive to deliver high-quality creatives built on proven direct response frameworks, we do not guarantee specific advertising performance, conversion rates, return on ad spend, or business outcomes. Advertising performance depends on many variables outside our control including your target audience, ad account structure, bidding strategy, and market conditions.
Limitation of Liability
To the maximum extent permitted by law, Advertile shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you to Advertile in the three months preceding the claim.
Termination
Either party may terminate the service relationship at any time by providing written notice before the next billing cycle. Upon termination, all outstanding invoices become immediately due. Any creatives already in production at the time of termination will be delivered upon receipt of full payment.
Governing Law
These Terms and Conditions are governed by and construed in accordance with applicable law. Any disputes arising from these terms shall be resolved through good-faith negotiation between the parties.
Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the new terms.
